1. Introduction and Acceptance
Welcome to Hazumu, an e-commerce platform operated by Mythical Boxes Ltd (Company Number: 15934210), a company registered in England and Wales with its registered office at 91D Grosvenor Road, London, SW1V 3LD ("we," "us," or "our").
These Terms of Service ("Terms") govern your access to and use of the Hazumu platform, website, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
Important: These Terms contain provisions that limit our liability and require disputes to be resolved through binding arbitration on an individual basis, not through class actions.

2. Service Description
Hazumu provides an e-commerce platform that enables users to create, manage, and operate online stores to sell physical and digital products. The Service includes:
Store creation and customization tools
Product catalog management
Payment processing through Stripe
Custom domain connection (coming soon)
Order management and fulfillment tools
Mobile-optimized storefront
The Service is provided on a subscription basis following the beta period, as described in Section 4.

3. Account Registration and Eligibility
3.1 Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.
3.2 Account Creation
To use the Service, you must create an account by providing accurate, complete, and current information. You agree to:
Provide truthful and accurate information during registration
Maintain and promptly update your account information
Keep your password secure and confidential
Notify us immediately of any unauthorized access to your account
Accept responsibility for all activities that occur under your account
3.3 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information.

4. Beta Period and Pricing
4.1 Beta Period
The Service is currently in a beta testing phase ("Beta Period"). During the Beta Period:
The monthly subscription fee is waived
Transaction fees will apply to each sale, consisting of:
Hazumu platform fee: 1% of the sale amount
Stripe payment processing fees: as determined by Stripe's standard pricing (typically 1.5% + 20p for UK domestic cards)
Total fees will be deducted from each transaction before funds are transferred to your Stripe account.
The Service is provided "as-is" for testing and feedback purposes
We may make changes, updates, or improvements to the Service at any time
The Beta Period will last approximately 6 months, ending on or around August 24th 2026.
4.2 Beta User Benefits
Users who join during the Beta Period ("Beta Users") will receive:
50% discount on the monthly subscription fee for the first 6 months after the Beta Period ends
30 days' advance notice before any charges begin.
Priority consideration for feature requests and feedback.
4.3 Post-Beta Pricing
After the Beta Period ends:
Monthly subscription fee: £9.99 per month
Transaction fees will apply to each sale, consisting of:
Hazumu platform fee: 1% of the sale amount
Stripe payment processing fees: as determined by Stripe's standard pricing (typically 1.5% + 20p for UK domestic cards)
Total fees will be deducted from each transaction before funds are transferred to your Stripe account.
Your monthly subscription fee will be charged on the same calendar day each month as your subscription start date.

4.4 Price Changes
We reserve the right to change our pricing with at least 30 days' notice. Continued use of the Service after the price change constitutes acceptance of the new pricing.

5. Payment Terms
5.1 Payment Processing
All customer payments for products sold through your store are processed through Stripe. By using the Service, you agree to:
Create and maintain a Stripe account in good standing
Comply with Stripe's Terms of Service and acceptable use policies
Provide accurate banking information for payouts
Accept responsibility for all transactions processed through your store
5.2 Transaction Fees
We charge a transaction fee of 1% on each sale made through your store. This fee is automatically deducted before funds are transferred to your Stripe account.
5.3 Subscription Payments
Monthly subscription fees are charged automatically through Stripe on the same day each month as your subscription start date.
All payment processing is handled securely by Stripe. Accepted payment methods include major credit and debit cards (Visa, Mastercard, American Express) and other methods supported by Stripe. For a complete list of supported payment types, see stripe.com/payments/payment-methods.
You must maintain a valid payment method on file with Stripe to keep your subscription active.
5.4 Failed Payments
If a subscription payment fails:
Stripe will automatically attempt to process payment again using Smart Retries or according to our configured retry schedule
You will receive email notifications from Stripe about the failed payment and upcoming retry attempts
Your subscription status will be marked as "past due" after the initial failure
After all retry attempts are exhausted (typically within 7-14 days), your subscription will be marked as "unpaid"
Unpaid subscriptions will result in your store being suspended (see Section 12.2)
You can update your payment method at any time in your account settings to resolve payment issues
To avoid service interruption, please ensure your payment method on file is valid and has sufficient funds.
5.5 Refunds
Monthly subscription fees are non-refundable except as required by law or at our sole discretion. If you cancel your subscription, you will retain access to the Service until the end of your current billing period.
Transaction fees are non-refundable, even if you issue a refund to a customer.

6. Usage Limits and Fair Use Policy
6.1 Standard Limits
Your subscription includes the following usage limits:
Storage: 10GB for images, files, and store data
Bandwidth: 100GB per month
Products: Unlimited
Orders: Unlimited
Images per product: 15 images maximum
Custom domains: 1 included (coming soon)
6.2 Fair Use Policy
The limits above are designed to accommodate typical small business usage. If your usage consistently and significantly exceeds these limits in a manner that affects Service performance or other users, we may:
Contact you to discuss your usage patterns
Request that you reduce usage to within reasonable limits
Offer you an upgraded plan (when available)
Suspend or terminate your account if excessive usage continues
We will always contact you before taking action and work with you to find a reasonable solution.
6.3 Prohibited Use
You may not use the Service to:
Resell or redistribute the Service to third parties
Create multiple accounts to circumvent usage limits
Use automated tools to generate artificial traffic or orders
Attempt to reverse engineer, decompile, or access the Service's source code
Interfere with or disrupt the Service or servers
Violate any applicable laws or regulations

7. Prohibited Products and Content
You may not use the Service to sell, promote, or facilitate the sale of:
7.1 Illegal or Regulated Items
Illegal items in the United Kingdom or the buyer's jurisdiction
Controlled substances, illegal drugs, or drug paraphernalia
Prescription medications or pharmaceutical products
Weapons, firearms, ammunition, or explosives
Tobacco products or vaping devices (without proper licensing)
7.2 Harmful or Exploitative Content
Adult sexual content, pornography, or sexually explicit materials
Items promoting hate speech, violence, discrimination, or harassment
Human remains, body parts, or biological specimens
Live animals
Stolen goods or items used to commit crimes
Items that exploit, harm, or endanger minors
7.3 Intellectual Property Violations
Counterfeit goods or unauthorized replicas
Items that infringe trademarks, copyrights, patents, or other intellectual property rights
"Inspired by" or knock-off products without proper authorization
Unauthorized use of brand names, logos, or celebrity likenesses
7.4 Financial or Fraudulent Schemes
Multi-level marketing or pyramid schemes
Securities, investment opportunities, or cryptocurrencies (without proper licensing)
Items requiring special licenses or permits without proof of authorization
Lottery tickets or gambling-related products (without proper licensing)
7.5 Other Prohibited Items
Recalled items or products subject to safety warnings
Misleading, deceptive, or fraudulent product listings
Services rather than physical or digital products
Items that violate Stripe's prohibited business list
7.6 Enforcement
We reserve the right to remove any listings or suspend accounts that violate these prohibitions. We may also report illegal activity to appropriate authorities. You are solely responsible for ensuring your products comply with all applicable laws and regulations.

8. Intellectual Property Rights
8.1 Hazumu's Intellectual Property
The Service, including its software, design, text, graphics, logos, and other content (excluding user-generated content), is owned by Mythical Boxes Ltd and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without written permission.
8.2 Your Content
You retain all ownership rights to the content you upload to the Service, including product descriptions, images, videos, and other materials ("Your Content"). By uploading Your Content, you grant us a worldwide, non-exclusive, royalty-free license to:
Store, display, and transmit Your Content as necessary to provide the Service
Create backups and derivative formats for Service functionality
Display Your Content to your customers and visitors to your store
This license ends when you delete Your Content or close your account, except for content that has been shared or cached by customers.
8.3 Responsibility for Your Content
You represent and warrant that:
You own or have the necessary rights to all Your Content
Your Content does not infringe any third-party intellectual property rights
Your Content complies with these Terms and applicable laws
You are solely responsible for Your Content and any consequences of uploading or publishing it.
8.4 Copyright Infringement
We respect intellectual property rights. If you believe content on the Service infringes your copyright, please contact us at admin@mythicalbox.co with:
Your contact information
Description of the copyrighted work
Location of the infringing content
A statement that you have a good faith belief the use is unauthorized
A statement that the information is accurate and you are authorized to act on behalf of the copyright owner
Your physical or electronic signature
We will investigate and take appropriate action, which may include removing the content and terminating repeat infringers' accounts.

9. User Responsibilities
9.1 Compliance with Laws
You are responsible for complying with all applicable laws and regulations, including but not limited to:
Tax laws and collection obligations
Consumer protection laws
Privacy and data protection laws (including GDPR)
Product safety regulations
Shipping and customs requirements
9.2 Product Accuracy
You must ensure that:
Product descriptions are accurate and not misleading
Product images fairly represent the actual items
Pricing is clear and accurate
Shipping costs and delivery times are clearly stated
Return and refund policies are clearly communicated
9.3 Customer Service
You are solely responsible for:
Fulfilling orders in a timely manner
Providing customer support to your customers
Handling returns, refunds, and disputes
Maintaining adequate inventory
Resolving payment disputes with customers
9.4 Data Protection
If you collect personal information from customers, you must:
Comply with the UK GDPR and Data Protection Act 2018
Provide a clear privacy policy
Obtain necessary consents for data collection
Protect customer data from unauthorized access
Handle data subject rights requests appropriately

10. Data and Privacy
10.1 Data Collection
We collect and process data as described in our Privacy Policy, available at https://www.hazumu.store/privacy-policy. By using the Service, you consent to our data practices as described in the Privacy Policy.
10.2 Your Customers' Data
When you collect customer information through your store, you are the data controller for that information. We process customer data on your behalf as a data processor. You must:
Have a lawful basis for processing customer data
Inform customers about how their data will be used
Ensure customer data is accurate and up-to-date
Delete customer data when no longer needed
10.3 Data Security
We implement reasonable security measures to protect data stored on the Service. However, no method of transmission or storage is 100% secure. You acknowledge that you use the Service at your own risk.
10.4 Data Export
Currently, automated data export functionality is not available. We are working to implement this feature in the future. If you need to export your data, please contact us at admin@mythicalbox.co, and we will assist you.
10.5 Data Backup
While we maintain regular backups, you are responsible for maintaining your own backup copies of Your Content. We are not liable for any loss of data.

11. Service Availability and Modifications
11.1 Service Availability
We strive to provide reliable service, but we do not guarantee that:
The Service will be available at all times without interruption
The Service will be error-free or secure
Defects will be corrected in any particular timeframe
The Service will meet your specific requirements
We provide the Service "as-is" without any warranties, express or implied.
11.2 Maintenance and Downtime
We may perform scheduled or emergency maintenance that temporarily interrupts Service availability. We will attempt to provide advance notice of scheduled maintenance when possible.
11.3 Service Modifications
We reserve the right to:
Modify, update, or discontinue features of the Service
Add or remove functionality
Change technical requirements
Update these Terms
We will provide reasonable notice of material changes when possible. Continued use of the Service after changes constitutes acceptance of the modified Service or Terms.
11.4 Beta Disclaimer
During the Beta Period, the Service is provided for testing purposes. You acknowledge that:
The Service may contain bugs, errors, or incomplete features
Features may change significantly or be removed
Data loss may occur (though we will make reasonable efforts to prevent it)
Service stability and performance may vary

12. Account Suspension and Termination
12.1 Termination by You
You may cancel your account at any time by:
Using the cancellation feature in your account settings
Contacting us at admin@mythicalbox.co
Upon cancellation:
You will retain access until the end of your current billing period
No refunds will be provided for the current billing period
Your store will be taken offline at the end of the billing period
Your data will be retained according to Section 12.4
12.2 Suspension for Non-Payment
If subscription payment fails and cannot be collected:
Days 1-14: Your store remains active; we attempt to collect payment and send email reminders
Days 15-30: Your store is suspended (offline and inaccessible to customers); data is preserved
Days 31-60: Store remains suspended; final warning emails sent regarding data deletion
Day 61+: Your account and all associated data may be permanently deleted
You may reactivate your account at any time during suspension by updating your payment method and paying any outstanding fees.
12.3 Termination by Us
We may suspend or terminate your account immediately if:
You violate these Terms, particularly Section 7 (Prohibited Products)
You engage in fraudulent, illegal, or harmful activity
You repeatedly violate our policies despite warnings
Your usage threatens the Service's integrity or other users
Required by law or legal process
We will provide notice when possible, but immediate termination may occur for serious violations.
12.4 Effect of Termination
Upon termination for any reason:
Your access to the Service will be revoked
Your store will be taken offline immediately
Your data will be retained for 60 days, then permanently deleted
You remain responsible for any outstanding fees or obligations
Sections of these Terms that should survive (liability, indemnification, etc.) will remain in effect

13. Disclaimers and Limitation of Liability
13.1 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF:
Profits, revenue, or business
Data or use of the Service
Goodwill or reputation
Anticipated savings
WHETHER ARISING FROM:
Your use of or inability to use the Service
Unauthorized access to your data
Actions of other users
Any other matter relating to the Service
EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF:

13.3 Limitations Acknowledgement
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
13.4 Third-Party Services
The Service integrates with third-party services, including:
Stripe for payment processing
Supabase for data hosting and storage
Resend for email delivery
We are not responsible for:
The availability, functionality, or security of third-party services
Any loss or damage resulting from third-party service failures or outages
Changes to third-party terms, pricing, or policies
Data processing or security practices of third-party providers
You are responsible for:
Complying with all applicable third-party terms and conditions
Maintaining valid accounts with third-party services where required (e.g., Stripe account for payment processing)
Understanding how third-party services handle your data (see our Privacy Policy for details)

14. Indemnification
You agree to indemnify, defend, and hold harmless Mythical Boxes Ltd, its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from or relating to:
Your use of the Service
Your Content or products sold through your store
Your violation of these Terms
Your violation of any rights of another person or entity
Your violation of any applicable laws or regulations
Any claims made by your customers regarding products, services, or transactions
This indemnification obligation will survive termination of your account and these Terms.

15. Dispute Resolution
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
15.2 Informal Resolution
Before filing any formal legal action, you agree to first contact us at admin@mythicalbox.co to attempt to resolve the dispute informally. We will attempt to resolve the dispute through good faith negotiation.
15.3 Jurisdiction
If informal resolution fails, you agree that any legal action or proceeding relating to these Terms or the Service shall be brought exclusively in the courts of England and Wales, and you consent to the jurisdiction of such courts.
15.4 Time Limitation
You agree that any claim or cause of action arising from or relating to the Service or these Terms must be filed within one year after the claim arose, or it will be permanently barred.

16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mythical Boxes Ltd regarding the Service and supersede all prior agreements and understandings.
16.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
16.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing and signed by us.
16.4 Assignment
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section is void.
16.5 No Agency
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and us. You have no authority to bind us in any way.
16.6 Force Majeure
We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labour, or materials.
16.7 Notices
We may provide notices to you via email to the address associated with your account, by posting on the Service, or by other reasonable means. You are responsible for keeping your email address current.

16.8 Headings

16.10 Updates to Terms
We may update these Terms from time to time. When we make material changes:
We will update the "Last Updated" date at the top
We will notify you via email or through the Service
The changes will take effect 30 days after notification
Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and may cancel your account.
